The H-1B visa category is for non-citizens who have a job offer to work in the US in a "specialty occupation," who will work as a notable fashion model, or who will contribute to a Department of Defence initiative.

·         Verify if the applicant's credentials include a relevant bachelor's degree or an equivalent set of training and expertise.

·         Determine the market price. The employer must pay the higher of the "actual wage" (wages paid to other workers doing the same job) or the "prevailing wage."

·         Submit a "Labour Condition Application" ("LCA") to the U.S. Department of Labour ("DOL") to verify that the intended employment of the H-1B worker conforms with particular salary and working condition criteria. The DOL will normally email you the approved LCA seven days after you submit it online using the FLAG portal.

·         If the petition is subject to the cap, sign up for the annual H-1B lottery with US Citizenship and Immigration Services (USCIS) to see if you'll be chosen among the many applicants (demand for H-1B visas always outstrips supply) and allowed to continue the process.

·         If you are a cap-exempt or the lottery winner, submit a petition on Form I-129 to US Citizenship and Immigration Services along with any required supporting evidence and filing costs. (USCIS).

 

When may an H-1B candidate begin employment in the USA?

There are different circumstances for when a new employee might start working, depending on whether they are based domestically or abroad.

An H1B student in USA who is currently in the country and working for another employer in H-1B status may be allowed to start working for the new employer once the petition is still pending, according to the USCIS Form I-797 Notice of Action that the new business has received.
